Port to Port Shipping Contract:

Why assume the total RISK of shipment?
By Kenneth Coffing, Corporate Risk Manager, HRM

Whether you are a one container a year buyer or hundreds of containers it is still a question “Why would you want to assume liability and risk for shipping across 5,800 miles of China Sea, Pacific Ocean, Atlantic Ocean or any other ocean?”

The fact is when you arrange to buy hazardous materials from the factories or brokers the standard answer is “It includes freight and we will take care of it”. The truth is “Their definition of taking care of it is placing your business in jeopardy”. Go back in your previous files and look on the line of the BOL / Shipping Manifest where it says “SHIPPER” and see if the broker put his name, the factory put their name or IF IT IS YOUR NAME? What they have done is placed 100% of liability on you solely of packing the container, loading the cargo onto the ship, stowage of container across 40 foot seas and unloading the container at destination port.

What is the answer? Simple: A shared BOL / Manifest called Port to Port ERS
Port to Port Emergency Response Service by Chemtel Inc.
Yes, ChemTel will provide any Shipping Factory / Distributor for only $100.00 USD unlimited shipments for as many customers they wish for one year at the flat fee of $100. This is to any country from Asia or Europe, including United States.

Now this sounds like a lot of money to the factory however to an American that knows if that ship catches on fire, is contaminated by leaking cargo, has an EPA issue or even worse is involved in an incident the Lawyers will be knocking at your door as the “SHIPPER” looking for deep pockets to sue for losses or environmental clean up on the ship line. They can not sue the Chinese because of the laws. They can sue you though!

So DO NOT requests the Asian or European factories to pay for the $100 fee. You sign them up paying the flat fee for your shipments all year. This would be your best insurance investment and most favorable RISK MANAGEMENT move ever made. You are now relieved of 80% of the transport liability, packaging & stowage. This could be your best investment ever! ChemTel provides the broker / fireworks factory their own 24/7 Emergency Response Service to place on BOL. It is you’re right to demand they share responsibility.

Once the container drops on shore in Seattle, Long Beach, Texas, New York or what ever port it arrives at then the next BOL properly places your name as the “Shipper”. Now the remaining journey to your warehouse is under DOT CFR 49 your responsibility. Only 20% of the journey!
