
Notice to all CHEMTEL client members,
ChemTel continually strives to keep our member client information current, not only to protect them from liabilities, but also to have accurate data on file to provide during Compliance Audits from Federal Agencies at our office. On a daily basis we receive calls from various national and international agencies to confirm the client member legal use of the Chemtel emergency shipping numbers. Regulatory authorities in the United States, and worldwide, monitor Chemtel’s compliance to the laws and ensure that we properly perform the duties that we are contracted to provide for our subscribers.
Over the years DOT, FAA and IMG have increased their enforcement on CFR 49 Transportation section 172.604 Emergency Response telephone number. As a result of increased DOT / FAA / IMG inspections and increased regulation enforcement, fines are levied much more frequently on you the “Shipper”. Because of this increased scrutiny ChemTel can no longer accept “Piggy Backs” from our subscribers. What this means is that if any company is not a DBA (a 100% wholly owned subsidiary) of the CHEMTEL client company, that individual company is responsible for maintaining their own 24-Hour Emergency Service (ERS) program.
Other issues to note:
- The ChemTel 24-Hour Emergency Service program contract was always and still is written to provide an emergency service and 24-Hour contact number to place on BOL, DGM, or shipping manifest on the emergency line. We also permit this same emergency number to be on the emergency contact line of MSDS if your company is a paid subscriber. However, the contracts do not permit the placement of our ChemTel emergency contact information on product labels or product packaging. A separate contract is required to permit the use of ChemTel Toll-free or International Emergency numbers on Product Label & Product Packaging.
- When any client sends in a paper MSDS or a non searchable electronic version MSDS, there is a $6.00 charge for converting this to a format which can be uploaded into our database. Questions regarding this can be directed to MSDS@chemtelinc.com No zip files accepted for MSDS.
- MSDS on Demand is a separate contract than the ChemTel 24-Hour Emergency Service program. For responders (IE: fire departments, hospitals, doctors, Hazmat team, etc.) ChemTel ERS staff will send, at no fee, the MSDS in your file should an incident or emergency arise related to a shipment in transit. All other MSDS requests (from your profile list of MSDS) will be billed at $4.00 per MSDS, whether sent by fax or e-mail. *see sourcing MSDS below.
- All contracts are based on the number of MSDS provided by your company. If your MSDS count increases the contract fee may be adjusted to account for MSDS growth.
- DOT CFR 49 Transportation requires every shipper to keep ChemTel up to date on personnel changes for emergency and technical contact. You may update this profile on our website by completing the SIF form for existing clients. Go to www.chemtelinc.com to forms/links drop down tab / existing SIF form.
- Requests for sourcing MSDS will be charged at a rate of $15 per MSDS if found internally on ChemTel database and $25 per MSDS if our staff must source outside the database.
- Renewal contracts are being sent out to clients that have been with ChemTel for many years. This is for your protection to comply with regulatory requirements. Please sign and return promptly. Please update the Subscriber Information Form (SIF) as well. You may access the Chemtel website to fill out and update new employees or staff changes on SIF forms on-line. Thank you.
ChemTel is committed to ensuring that our clients are in compliance with all State, Federal and International Transportation Regulations. In order for us to provide this service to the best of our ability, our subscribers must also be committed to providing to us current, accurate technical data and shippers contact information supporting the shipments. The “Shippers” cost of compliance with shipping regulations is very small when compared to the exposure to liability and enforcement actions that come with non-compliance to shipping regulations.
Intentional misuse or illegal use of the ChemTel Emergency Response Program or intentional illegal use of the ChemTel North American or International emergency phone number may be reported to DOT, FAA, IMG and, if deemed a National or International security issue, to Homeland Security.
